Ok so I'm wanting to buy this but unsure if its new or not:

Yeah. Also, if it's like the UK version, just before you confirm your payment and order, it'll tell you whether it's new or not:

i.e. Condition: New

And I think unless it's from the Marketplace, it should always be new.
