SourceEA is being taken to court for failing to keep its promise that the PlayStation 3 version of Battlefield 3 would include a free copy of Battlefield 1943.As reported by Kotaku, US law firm Edelson McGuire filed a class action suit against EA today on behalf of disgruntled PS3 owners. The suit isn't focusing on the fact that EA went back on its promise, but that it was announced after the game had gone on sale and even then only via Twitter, meaning many customers were unaware of the fact.It alleges that EA "misled and profited from thousands of their customers by making a promise that they could not, and never intended, to keep."According to the lawyers, all that those signed up to the class action want out of EA is the free copy of 1943 that they were originally promised. We've approached EA for comment and will update if we hear back.
I wonder how this will pan out. Hopefully it goes all the way and EA have to give out what they first promised.

Unless they have some insider docs, it's going to be really hard to prove, "Never intended"...

Yeah, EA need to do something. Saying "Oh, you don't get that no more. You can buy some extra maps early though" isn't going to cut it. I bet there were many people who bought BF3 on the PS3 on the basis that they'd be getting 1943 for free. I know i would've

I never even heard about the deal and I already owned 1943. I can understand upset people, however.
But is suing really the best way to go about this? Couldn't people just raise a stink on their social networks? I'm sure they'd get something out of this faster than suing.

So will THQ be sued for not living up to their "exclusive mode for PS3" promise in Saints Row 3?
Pretty silly if you ask me. There's so many companies doing these kind of things so to pick out one just to make an example is bullshit. Especially over a freaking 2 year-old $15 PSN game...

Well THQ have come out to say they will give people SR2. So it's not like they're doing nothing, like what EA are doing in this case. It's all about principle and not getting bent over by companies.

They've confirmed that the EU gets SR2 now as well. But yeah - you shouldn't promise one thing and give another.

Ah, then yeah, EA needs to get their stuff together. Money was already made on Battlefield 1943 a long time ago so there is no reason they should be reluctant to do this, especially given it has obviously acted as a good means of promoting the new BF3 game.

If they win surly we can all take EA to court? (even though i bought the 360 version haha)
-
11-19-2011 #18
I hope EA loses. Maybe it'll teach companies to keep their fucking mouths shut if they aren't 100% sure they want to follow thru with a deal.

Serious matters like what? Allowing mothers who kill their children to get away with it? Or finding some loophole to make the rich richer and the poor poorer?
I hope EA gets dealt with in this case. It isn't the matter of some shitty 10 PSN game as some of you like to say. It's the principle of the whole situation. It's a big corporation saying "Yeah, we got you. Here is BF 1900" Then soon as you buy it for said platform they give you a "lol, my fault". That's bullshit and you should be dealt with because of it.
But as long as you don't care they will continue to do dumb shit like this. Online passes anyone?

It's all about not allowing companies to dick the customers over at any given chance. Really don't see how anyone can support EA in this instance when they're clearly in the wrong

Its not about supporting EA, its the cost/time involved vs what you would win. Best case, court finds in their favour, congrats, heres your code to download 1943, wow, that was worth it!
Put it this way, how many hours of an individuals time would it take to take this to court, if its more than 1 its not worth it because you can earn the cost of the game on PSN doing an hour extra at work.

Whilst I think this is a worthwhile task (it may be $10 to you and I, but $Millions to EA) I sometimes wish consumers would stand up for themselves on some other important issues that we seem to now accept as the norm. Example, broken/poor quality games released anyway.

I agree with whoever is suing, I don't think it's the cost of the game, it's the principle. EA promised something which was advertised as an incentive to get the game and then they went back on it, which shouldn't be allowed.
