to reiterate it sucks but the law is the law. Somebodies lawyer has done a very very good job and is getting a massive pay rise. People get off on technicalities all the time.

The law protects everyone from persecution because that's the way it should be. Sure there are a few cases of failure which happens in any society and any judicial system but if it's going to err I'd rather it err on the side of caution.

By definition of the law he didn't. Is it an outdated law? Yes. Should they change it? Yes. But you can't simply throw this guy in jail in spite of the letter of the law because "Oh he's guilty." That changes everything. Now judges and juries can find you guilty in spite of the law just because "I don't agree with what you did." It becomes subjective instead of objective. It leaves justice to be dealt at the whim of people. Flawed people who have moods, who make errors in judgement, and who are biased towards their own beliefs and values. Part of what makes justice blind is that the same laws are applied to everyone. You're suggesting that the law be applied differently in this case. Different laws for different people isn't justice. Is the current system perfect? No. But it's the closest we've gotten.
