Microsoft has filed a trademark application with the United States Patent & Trademark Office (USPTO) for a new project called "Gunpowder." The trademark description sheds little light, noting only that the mark will be used for "entertainment services, namely, providing online video games." The trademark application was filed January 15. A Microsoft representative was not immediately available to comment.
The USPTO in November denied Microsoft's trademark application for Killer Instinct, citing possible confusion with Fox's since-ended TV series of the same name.

Doesnt MS already have a trademark on Killer Instinct because of their purchase of RARE from Nintendo so many years back o_O?

They both become utterly useless once you start to open up Windows....

They had the trademark for a TV show, Microsoft was trying to get the Trademark for an obvious HD remake of the series. Probably will just call it KI.

Thats whats confusing tho. FOX has a trademark for a TV Show, MS already has a trademark for the game franchise carried over from the RARE predating the TV show by over a decade so why would they not beable to use it for another game in the series because of the TV show?

The Patent/Trademark system is broken.
Pretty sure no one would confused Killer Instinct the failed canceled before a full season who with the game.
