Its all about intent. I hate that word but as some one who is close to the law, I imagine its used in your legal system as much as its is in ours.

Going round in circles here a bit, but he hasn't been punished for having the console early, he's been punished for what he did when he got it.. You say "We'd have all done the same...", well I'm sorry but this seems to be a problem with the younger generation in that they feel they can post anything online.. It's not the case I'm afraid, they are tightening up and adjusting laws all around the world all the time. I mod on a (non gaming) website with over 50,000 members, I know first hand the trouble people can and do get into by posting things they ain't meant to, be it images/descriptions of illegal activities or copyrighted material..

If it wasn't intended for public use, he wouldn't have had access to it by using the console as a consumer product.

Can we mention street date in this?

Street date is for retailers to release a product, not related to whether a consumer can use it if they received it.

Comes back to intent, MS does not intend anyone to own a console at this point, therefore the network is intended for only testing purposes. In short the product is not intended to be for sale. The firmware is not intended for anything other than testing purposes and anything the guy digital signed legally or not could be argued easily away by MS as not being legally offered to him.

They didn't intend for anyone to own the console. No problemo. That doesn't have to do with the copyright from someone legally paying for it, and receiving it. Then they used services that were accessible to the public.

They should have either not had any consoles out, that could be delivered, or they should have had the network inaccessible. It was legally offered to him. The street date isn't relevant to the consumer.

Well, me thinks the proof is in the pudding......
P.S. We could argue on and on, I can certainly see how lawyers make bazillions and no one gets anywhere.

Sorry I am somewhat uninformed with respect to the actual occurrence as it happened; if MS allowed him to do it I'm sure he would have signed some sort of waiver saying he wouldn't disclose info- in that case he's up the creek lol. It's pretty easy for Sony to sit back and say: Oh we wouldn't have a problem with that ", but what they say and what they do are not always the same thing. I have had some very negative experiences with PS3 and Sony was not always very helpful or even polite. All businesses are just that, businesses and they really do not care about consumers as much as they like to pretend. Many times I have considered switching to MS, but titles like Kingdom hearts kept me loyal- now KH3 is on both platforms and I think to myself: what is there now that makes me stick with sony? I still don't know the answer to this question.

Hey man, sorry we had to cut you off. If you stop telling everyone all the stuff about the console, we're going to let you come to the launch event.

Why would they ban him/ Did he steal it off the back of an MS truck?

If he got it through no fault of his ownthen it's not right. Tell me that if ypu got any new device that you wouldn't open it because you "respect" a company or whatever.

I'd open the shiz out of that XB1 if I were him.

Still not his fault. If they want to stop him talking about it, but he can still play, then that's less of a $#@! move. Either way, not his problem so he shouldn't get shafted.

Basically, as mynd explained it, his console is banned from using Live. They don't want anyone to use it, and they have it easily accessible to those who have the console. It will be unbanned a day or so before the launch.
