You won it? WTF? I wanna win a prize like that... sh-yt. Was it some sort of compensation for damage or a regular sweepstakes?

-
10-13-2005 #11I didn’t necessarily win it, which is why I wrote 'let’s just say'. I would rather not get into how I got it, it’s a long story

I know what happened... you sued a telemarketer, right? People make it their jobs these days to just sue overzealous tele's who just dont stop calling, even when they are on our "do not call" list. 1000 USD a case.
-
10-14-2005 #16
Really? You can sue for that? I know they get fined like thousands of dollars but I didn't know you could actually sue.

Oh yes it is very possible to sue for sure. I worked as a telemarketer for at least 2 years. I sold Discover Credit Cards out of Canada into the States. Who knows maybe I called someone here on the forums even!
Ånyways onward to what I wanted to say. When a request was put in to be placed on a "Do Not Call List" our company was only obligated to keep your name on this list for a period of so long. Sometimes it was 6 months and other times it was a year. Depending on what we were selling that day (Also did sales for Verizon, SBC, Quest, etc.). In our closing speech given to the person on the phone was that the duration needed to take your number off the calling list was 30 days (Way to long if you ask me.) Now during those 30 days your number would still have been in our system so chances are you would have been called again. However, after the 30 days were up and you were called again you had full right to file a lawsuit against the company that was contacting you (Not the person calling). Since of course we had absolutely no power over who we were contacting. Our company used a dialer that would automatically generate numbers.
I tell you those 2 years were the worst of my life! These types of companies are frowned upon so much it is unreal. However, here in Canada in the region I live in $9/hr was a good salary for a guy fresh out of college looking for some summer work. The salary ended up keeping me there for 2 years. Not to mention I got $6 for every credit card sold, so that added up too.

10-15-2005 #19Sorry to hear the bad news. You could probably sue, depending on the length of time since you told them to stop (as mentioned earlier). But you should also double check because maybe each state has a different law
