Portions of Martha Hart's lawsuit against WWE and the McMahons over the use of Owen Hart's likeness were dismissed in court within the last couple of weeks. On November 16th, the judge in the case threw out parts of the lawsuit against WWE, though exactly what was dismissed and what remains is not confirmed. The portions of the lawsuit that were remaining before the partial dismissal were the following claims:
* That Owen's name would have reverted back to strictly his usage after his passing
* That his legal name would not be considered his character's name (i.e. that WWE did not have the rights to use, market and promote him as Owen Hart)
* That WWE released several DVDs other products such as the WWEEncyclopedia without giving Hart's estate proper payments per his booking contract
* That WWE used "original intellectual property" (e.g. family photos) without the permission of Owen's estate
* That the Owen Hart Foundation has been hurt by the unwanted association with WWE due to WWE's usage of Owen Hart's name and likeness
In addition, a motion to dismiss Martha's copyright infringement suit against against Vince McMahon personally was partially approved as it was ruled that Martha had "failed to present sufficient evidence of McMahon's vicarious liability for copyright infringement." It was noted that in order to establish liability, Hart had to prove that McMahon had "the right and ability to supervise and an obvious and direct financial interest in the exploitation of copyrighted materials" and that she failed to do that since the only proof presented was that Vince is WWE's President and majority shareholder.
Linda McMahon was not mentioned in any of the rulings, meaning that the lawsuit against her may still be proceeding. The McMahons did not get their requested sanctions against Hart's lawyer to pay for legal fees approved, nor their request to have certain remarks made in Hart's latest amended lawsuit stricken.

it's an extremely messing business between them both... That poor family that lost a father, son, brother
and the WWE that lost the rights to his image.... Sure the wwe is going to lose millions... But the family has lost infinity that and beyond
The only thing that matters is finale peace for the family and closure to this sad state of affairs

I remember Maven, he got twatted by undertaker at RR 2002 for flipping him per the rope and eliminating him haha....whipped him into a popcorn machine backstage I believe....ahaha how I miss the attitude era :S

Yeah I remember Maven too. He had an impressive dropkick but that was pretty much it. He was never going to make it big in WWE. Given the talent pool on the roster by the time he debuted, he wasn't going to even sniff the WWE title let alone hold it. He pretty much lost all his steam within 6 months and when they tried to push him again it flopped.
His biggest claim to fame is dropkicking Undertaker out of the ring and getting beaten like nobody's business for doing so, at least that's how I remember him (along with his goofy eyebrows)..
Last time I heard of him he was selling stuff on tv lol. I haven't seen him wrestle since 2006 though, nowadays he has this huge back tattoo (what Tyson Tomko has on his shoulders he has on his back). Didn't he get arrested for drugs a couple years ago too?

I always thought Tomko was underutilised. He had a great look imo and from what I can remember was passable/good in the ring. (it's been atleast 2 years since I've watched a Tomko match lol, I honestly can't remember much about him other than his appearance and him Powerbombing Jericho through and announce table)

Nathan Jones had an impressive look, and god those vignettes they used to air for him were awesome. "The Colossus Of Boggo Road" cool nickname with a cool background of being an ex-prisoner. Unfortunately for him he was absolutely terrible in the ring.
Actually he was so bad they changed the tag team match from WM19 (A-Train/Show vs Taker/Jones) to a handicap because they knew he wasn't ready. (and he wasn't because he botched his roundhouse kick there too).Last edited by XMW; 12-02-2012 at 11:34.

The hand over of power in the WWE is coming quick and steady,
Now that Vince is rarely spotted at any of the two brand tappings. And the fact he is handing nearly all power of control of shakedown tappings, talent control, production layout, storyline control and layout of wrestling match etc etc to triple h
Means a more relaxed approach and happier backstage atmosphere... Were is when Vince is there talking and laying out what the king and jr etc etc have to say... At the curtain, it's the only time talent see or even talk to Vince...
