Square Enix and Sony taken to court.

June 4,2010 by Jim Reilly

A class action lawsuit has been filed against Square Enix and Sony Computer Entertainment America for selling copies of Final Fantasy XIII that allegedly freeze and even break PlayStation 3 consoles.

The lawsuit, filed on June 2, 2010 by Daniel Wolf of San Diego, Calif., alleges Final Fantasy XIII has caused "severe and widespread damage" to Sony PS3 gaming systems since its release on March 9, 2010. The lawsuit states that, for many consumers playing Final Fantasy XIII, has "caused their PS3 consoles to freeze and become totally and permanently inoperable." Wolf said he purchased a copy of Final Fantasy XIII the day it was released, and when attempting to save his game, his PS3 became unresponsive and would no longer play any other media after restarting it.

"Both Defendants are eminently aware of the damage being cause by their defective products, and have chosen to do nothing about it," the lawsuit says.

The suit also alleges that both Sony and Square Enix blamed the issue on one another. Square Enix said the issue resulted from Sony's console, and Sony blamed the issue on a faulty Final Fantasy XIII game disc. Neither company allegedly offered to cover the cost of repairing PS3 consoles.

The class seeks more than $5 million in damages and other financial relief.

Square Enix has not responded to requests for comment at this time. Sony told IGN it does not comment on legal matters.

Same here, the game has run perfectly for me and I've invest about 137hrs into it. Obviously sucks for persons who have this problem but I do not think it is as widespread as the defendant suggests. None of my friends have the problem and neither have I heard anything of the sort on any forum I have visited.

Well that ribbon thread I made was about my 60 gb PS3 kicking the bucket while playing FF13.

I am not sure what to think about this.

I mean, what's the average death ratio for every game that's been made? What is acceptable and what is not?

But really though, I think the fatties have been around long enough and ffxiii just puts enough strain on those ps3's that have been used a lot, that they are just pushed to the brink of breaking.

That is just my theory though... Someone might go say Uncharted 2 or God of War 3, maybe not as many peoples fat PS3's are breaking from playing those games at this point in time.

On the other side of the coin though, if Sony and Enix cared enough to blame one another, I am inclined to believe that something may be up.

Well, it happened to me only once. I was loading up my game. While the game was loading, which is when the game gives the brief synopsis with what you left off. It stayed that way for a long time until numerous of times I had to restart the game and the proceed button came out. I was glad, and I also notice when I cancel out of my character menu, it loads a bit to get cancel.

wow, look like someone is boarding the same express train the Linux crowd is using. But packing more greed for the ride!

Or they could just call Sony service and Sony said it could be the disc, so they call SE service department and SE said it could be the hardware. This is just basic customer service shannanigans, I'm pretty sure everyone on this forum has experience this.

Doesn't this happen like, every single time their is a new game release or a new firmware release?

My PS3 died while playing "insert game title here". "before mentioned game" broke my PS3!!!!!!!!!!!!!

I've heard this said already hundreds of times pertaning to numerous different games by now. Sorry, your system just decided to break on you and that just happened to be the game, movie, or CD tat was in the system when it did.... Hate to be the beare of bad news.

FFXIII runs perfectly fine on all of my PS3s...... Fat ones included.
Can't be as widespread as they seem to think. I've never seen or heard of the problem. Noone I know seems to have or heard of the problem and it seems the people here don't either....
Doesn't sound like it's a widespreadissue to me. ;)

You know why they sue for so much right? The Lawyers take their cut from however much is awarded, so the more they can get you, the more they can take. Thats why everytime someone sues a company, its for umpteen billion dollars these days. I'm sure most people would be happy with a few hundred grand. Heck, most people would be happy with being compensated for the monetary cost of their time and trouble and to cover expenses dealing with their hardware issues, but the lawyers push the big money lawsuits.

Or they could just call Sony service and Sony said it could be the disc, so they call SE service department and SE said it could be the hardware. This is just basic customer service shannanigans, I'm pretty sure everyone on this forum has experience this.
