Immersion pays Microsoft $20 million

Posted on August 27th, 2008 at 07:22 EDT

In a rather strange turn of events, Immersion - the infamous patent holders for rumble technology - have been forced to pay Microsoft a one-off fee of around USD 20 million as a result of Sony implementing the technology in its DualShock 3 pad.

According to the legal wranglings, Microsoft tied up a deal when designing the 360 controller that included a clause for a USD 15 million payout from Immersion should Sony ever licence the technology for their own use.

Immersion initially refused to pay when DualShock 3 was eventually released, but Microsoft has now won the resultant legal case for a whopping USD 20.75 million in total.

All of which is rather silly, and hopefully the last word on the subject for any future generations of hardware.

Unfair practices, I told you guys months ago. They forced emmersion to make things difficult for sony so that they wouldnt have to pay the 15 million dollar fee for settling with sony!

microsoft should be sued for inumerable reasons, for example, they should be sued for selling faulty goods, as in teh x-box please fix me. i mean its completely illegal to sell goods that are known to be faulty, sony and nintendo should do the right thing and sue micrsoft

I find it bizarre that MS could tie up that initial deal, considering that rumble was already used in DualShock 2, which existed before MS had even entered the console market.

I knew that M$ coming to console market wouldn't be good. If you look at it. Immerson didn't pay the $20 mil. We did, It was clearly a @#@! move to grab a quick buck from Sony and it's install base. I now fully understand why Sony didn't put rumble in the controller at first. The fans really wanted it back so Sony put it back in. I now wish Sony would've came up with a newer patent free technology instead of rumble. Just to stick it to M$. I still think before it all said and done. Gamers will find out who's in the market for the quality of product and who's in it for the monoply of money.

first of all immersion sued MS roughly 20mil so they jus got their money back 2nd Sony had a fallout with Immersion so thats why they didnt get rumble and when that was patched up immersion had to pay some of the money from sony which was 15mil and extra for any extra costs from sony over 100mil.

not only is the final straw for me against Microsoft. I still think a little blame goes to the patent office for patenting things that have already existed. First in-game music and now Rumble-tech. Gonna be nice to see what format the next gen of xbox will use for their games. Stay on DVD-rom or use blu-ray.

Truly the world has gone mad when such vast amounts of money are exchanged for what is basically a technology that makes the controller shake.

Who actually thinks rumble is any good? I mean c'mon, its not as if it really adds to the realism when playing games, even like GT or Burnout, all you say to yourself is "oh the controller is rumbling" you don't say to yourself, "wow, i can feel the road"

Totally pointless technology in my view, all it has done is given the near perfect sixaxis more weight and i dare say reduced battery performance (yes i know i can disengage rumble)

dang microsoft some b****** they specifictly sued them cuz it was in the dualshock controller, but oi dont understand how they won this case because we had rumble way back in ps1 that doesnt make since somebody should look at this again. i mean wii has rumble in it and microsoft doesnt say a thing and the wii is kicking its but and it came out after it. i hate microsoft so much i will never buy one of there systems.

Patent system is a complete scam nothing more ... I'm sure they sell new applications to these giants.  Patents are completely useless nowadays!  Get rid of them

This isn't fair but Microsoft doesn't play fair. Thats how you know their scared.

Okay there seems to be some confusion so I will try to sort it out for you. In the beginning Imersion sued Microsoft and Sony for using their (Immersions) rumble technology in the PS2 and Xbox. Nintendo was not sued because they had proof they had designed their own rumble technology. Microsoft settled the lawsuit out of court by paying Immersion some odd amount of money (I don't know how much) so that they (Microsoft) could continue to use the rumble technology. And so they wouldn't have to pay more money should they lose the lawsuit against Immersion. Sony however thought they could win so they decided to pursue the lawsuit. In the end Sony lost the lawsuit and ended up having to pay Immersion much more then they originally would of had to pay had they settled out of court. Up until the lawsuit ended Sony could also not incorporate rumble technology into the PS3 (Some believe this is why Sony introduced the Motion Sensor technology into their controllers to offset the lack of vibration). Once the lawsuit ended and Sony paid Immersion the money they owed, Immersion and Sony worked together to implement rumble back into the PS3 controller. Immersion does collect royalties on every PS3 controller sold with rumble in it. (Not sure about PS2 controllers). I think the rest about Microsoft is covered in the article above.
